ADJUDICATION WITHHELD- The judge is withholding a conviction. (The person was found guilty, but will not have a conviction on their record.) ASSAULT- An unlawful threat or unsuccessful attempt to do physical harm to another, causing a present fear of immediate harm. CIVIL SEARCH- This is a special request search provided by vendors that researches a subject for any civil action or claims within the subjects state of residency. CLEAR- No criminal records on the subject submitted. CONVERSION- Unlawful appreciation or use of another's personal or real property. CRIMINAL CONTEMPT- When a person uses personal or real property without the owner's consent. DIVERSION- A conviction until diversion has successfully been completed. Diversion is a program that is similar to probation, but consists predominantly of first time offenders. Even if an individual has an intervention or diversion program, they still have to admit to the charges on their application. FELONY- A major crime, as murder, arson or rape, for which stature usually provides a greater punishment than for a misdemeanor: the usual minimum penalty is imprisonment for one year. FEDERAL SEARCH- This is a special request search provided by vendors that researches a subject for any Federal offenses within the Federal Districts of the subjects state of residence. FORFEITURE- The charge is not a Felony or a Misdemeanor and is usually given a fine. HITS- A felony or misdemeanor charge filed on a subjects record. INFRACTION- The breaking of a law, pact, etc.; violation; infringement: Another phrase for a traffic violation. MINOR MISDEMEANOR- A misdemeanor that constitutes a lesser charge such as confinement of dog, jaywalking, fishing without a license, ect…. Which usually will only have fines and costs as a sentence. MISDEMEANOR- Any minor offense, as the breaking of a municipal ordinance, for which statute provides a lesser punishment than for a felony: the penalty is usually of fine or imprisonment for a short time (usually less than one year) in a local jail or workhouse. SKIP TRACE- A search through Trans Union in which we enter a subjects social security number that provides us with name and address's for the past seven years. THEFT- Theft is a general term and LARCENY is a legal term for the unlawful or felonious taking away of another's property without his or her consent and with the intention of depriving the person of it. Robbery in its strict legal sense implies the felonious taking. |
